New York court reverses child custody decision

Olympic skier Bode Miller recently lost custody of his nine-month old son; however, the loss may be temporary. The biological mother was awarded temporary custody on Nov. 25 in Manhattan Family Court. Previously, the child custody dispute had been heard in California, but was subsequently moved to New York.

This is an especially visible and complicated child custody case since the father and his new wife are public figures. Miller is an Olympic gold medalist and will be returning to the games in February, where hopes to take his son with him. He said his son would not remember the games but at least the boy would know that he had been there. Miller's wife is Olympic and pro beach volleyball player Morgan Beck.

The baby was born after an affair between Miller and the mother before his marriage to Beck. The baby's mother moved from California to New York where the baby was born Feb. 23. She said she moved to attend an Ivy League School on the G.I. Bill, but a California judge said the move was "reprehensible." Miller filed for and won child custody soon after the baby's birth. The child had been living with Miller and his new wife until the recent court ruling granted temporary custody to the baby's biological mother.

Consulting with an experienced child custody attorney may be a smart move in custody and visitation cases. An attorney who is experienced in dealing with the differing facets of child custody may help a father or mother to keep physical custody, assist in getting child custody modification or obtain visitation rights.
