Megan Fox divorce: Injured spouse may receive spousal support

Alimony is a way of balancing the financial status of spouses when a marriage ends. Although men or women are eligible for spousal support, women traditionally have been recipients. Women were and still are the spouses most likely to sacrifice careers to care for children and earn less for working than male counterparts.

However, times have changed in many ways and so have alimony laws in New York and in many other states.You hear more stories these days about women being ordered to pay maintenance and alimony to former husbands. The most recent reports claim Brian Austin Green, a former TV heart throb for his role in the show "90210," will receive spousal support from his film actress wife, Megan Fox.

Fox filed for divorce recently citing irreconcilable differences after a story broke the high-profile couple had separated. The 29-year-old actress reportedly requested shared legal and physical custody of the couple's two sons, ages 2 and 18 months. Yahoo reported the couple never signed a prenuptial agreement prior to their five-year marriage.

Green's earnings have not been on par with his wife's, especially since the couple was involved in a head-on collision with a drunk driver in December. Green was unable to work after a diagnosis of vertigo, which causes constant problems with balance. Reports say the couple's separation apparently occurred about two months after the crash, which left Green bedridden most of the time.

TMZ stated the 42-year-old Green probably will receive spousal support from Fox due to the vertigo and the spouses' widely-dissimilar incomes. The West Coast couple live in a 50-50 split community property state, unlike New York where marital property is divided fairly rather than equally under equitable distribution laws.
