Prenups not unromantic; couples benefit from open discussion

If you are considering getting married in New York, you may be thinking about the usefulness of a prenuptial agreement. More and more couples are learning about the benefits that can come along with a prenup -- not the least of which is protecting valuable assets. Prenuptial agreements may seem decidedly unromantic, but they are invaluable when it comes to dividing property during a divorce, or even when one spouse dies. Every couple can benefit from the provisions of a prenup.

You may feel uncomfortable broaching the subject of a prenup with your significant other. Remember that the use of a prenuptial agreement does not mean that you intend to divorce your spouse in the future. You are not expecting to dissolve your marriage if you consider a prenup. Instead, you are responsibly planning for the future by protecting your assets.

Consider the situation of an older couple that is getting married after having children. Without a prenup, inheritance rights could come into question. Further, older couples who have established businesses may want to protect their commercial interests; a prenup can help with that. Pensions, real estate and other valuable holdings can be shielded from marital property division with the use of a simple document.

Drafting a prenuptial agreement may also help you and your spouse make other relevant decisions about your future. You may be able to assign responsibility for religious education of your children, for instance, and you can discuss potential scenarios for relocation or professional changes. You might not have the answers for these questions immediately, but negotiating your prenuptial agreement can prompt you to think about the big topics that should be decided before marriage.
